These Terms of Use («Terms») govern access to and use of the GiftPool online service («GiftPool», «we», «us», «our»). Please read them carefully before using the service. By using the GiftPool service, you acknowledge that you have read these Terms, agree to them, and agree to our Privacy Policy.
1. General Provisions and Acceptance of Terms
1.1. By using GiftPool, you confirm that you have full legal capacity and are at least 18 years old.
1.2. If you do not agree with these Terms, you must not use the service.
1.3. GiftPool is an informational tool for organizing and coordinating gift fundraisers. GiftPool does not accept, store, transfer, or process funds. All money transfers are carried out by users independently through third-party banking and payment services.
2. Purpose and Use of Service
2.1. GiftPool helps organizers and participants coordinate fundraisers: create pools (fundraisers), mark participation, and record contribution amounts.
2.2. All information about contributions is for informational purposes only and is provided by users themselves.
2.3. You agree to use the service exclusively for lawful purposes and not to violate the rights of third parties.
2.4. You are responsible for maintaining the confidentiality of your account credentials and all actions performed through your account.
3. Account and Security
3.1. You must provide accurate and up-to-date information when creating an account.
3.2. Transferring your account to third parties is prohibited.
3.3. We reserve the right to suspend or restrict access to your account if there are signs of:
- violation of the Terms,
- fraudulent activity,
- security threats,
- legal requirements.
3.4. In case of suspected unauthorized access, you must immediately notify us.
4. Transfers and Interaction Between Users
4.1. GiftPool is not a banking or payment organization and does not accept, transfer, or process funds.
4.2. All transfers between fundraiser participants are executed outside the service — through mobile banking, P2P services, and other systems not connected to GiftPool.
4.3. GiftPool displays only information provided by users. A contribution mark in GiftPool does not confirm the fact of an actual transfer.
4.4. All disputes regarding refunds, delays, erroneous or unpaid payments are resolved exclusively between users, without GiftPool's involvement.
4.5. Users are independently responsible for bank fees, taxes, currency restrictions, and other financial obligations related to transfers.
5. User Content
5.1. Users may post text, images, fundraiser titles, and other content («User Content») in the service.
5.2. The user retains rights to their content but grants GiftPool a non-exclusive, perpetual, free license to use it within the service's operation (display, storage, processing).
5.3. It is prohibited to post content that:
- violates third-party intellectual property rights,
- contains insults, threats, hate speech,
- violates laws or promotes illegal activities,
- contains malicious files or malicious code.
6. Prohibited Activities
The following are prohibited:
- using the service for illegal fundraisers or fraud;
- attempting to gain unauthorized access to GiftPool or other users' accounts;
- performing technical attacks: DDoS, password cracking, scraping, penetration;
- posting malicious code or links to malicious materials;
- using the service in a way that disrupts the normal operation of the platform.
7. Access Termination
7.1. We reserve the right to suspend or delete your account if:
- Terms are violated,
- prohibited content is posted,
- there is a security threat,
- official requests are received from competent authorities.
7.2. We will try to notify you in advance, except in cases of obvious abuse.
7.3. After account deletion, some data may be retained for legal compliance or abuse prevention purposes.
8. Warranties and Disclaimer
8.1. GiftPool is provided «as is» and «as available», without any express or implied warranties.
8.2. We do not guarantee that the service will operate continuously, error-free, or completely securely.
8.3. GiftPool is not responsible for:
- user actions,
- accuracy or reliability of information provided by users,
- quality and outcome of fundraisers,
- failures or limitations of third-party payment services.
9. Limitation of Liability
To the maximum extent permitted by law:
- GiftPool is not liable for indirect, incidental, special, or consequential damages;
- our aggregate liability for any claims related to the use of the service is limited to the amount actually paid by the user for paid features of GiftPool in the last 30 days (if any).
This exclusion does not apply to liability that cannot be limited by law (e.g., harm to life and health, intentional harm).
10. Changes to Terms
10.1. We may update the Terms from time to time.
10.2. We will notify users of material changes through the service interface or email.
10.3. By continuing to use the service after changes take effect, you confirm your agreement with the new version.
11. Applicable Law
The Terms are governed by the laws of the Republic of Kazakhstan.
All disputes shall be resolved in the courts of this jurisdiction.
